Terms & Conditions

By registering an account on PehchanKaun, placing an order, or using any part of the platform operated by Transformatrix Pvt Ltd ("we", "us", "our"), you ("Client") agree to be bound by these Terms & Conditions. If you do not agree, please do not use the platform.

These terms apply to all Clients (businesses and organisations that purchase background verification services). Separate terms govern candidates' (data principals') use of the consent and verification flow.

PehchanKaun is a background verification SaaS platform that allows Clients to:

• Create background verification orders for candidates (prospective or current employees)
• Collect candidate consent and personal data through a consent-first workflow
• Run automated verification checks via third-party API integrations (identity, financial, employment, education, criminal records)
• Access verification results and downloadable PDF reports
• Manage bulk orders, team access, and billing through the admin dashboard

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We do not guarantee uninterrupted availability of third-party verification APIs which are outside our control.

• You must provide accurate company and contact information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Only registered businesses and organisations with a legitimate, lawful purpose for conducting background verifications may use the platform.
• You must promptly notify us at info@transformatrix.in of any unauthorised access to your account.
• You may not share login credentials between multiple individuals unless through the sub-user management feature.

You agree and warrant that you will only initiate background verification checks after obtaining the candidate's explicit, informed, and free consent through thePehchanKaun consent flow or an equivalent process that meets the requirements of the DPDP Act 2023.

Specifically, you agree that:

• You will not attempt to bypass the consent step or directly submit candidate data without consent.
• You will only run verification checks that are relevant and proportionate to the employment purpose.
• You will handle the results of verifications in compliance with the DPDP Act 2023 and applicable labour laws.
• You will not use verification results to unlawfully discriminate against candidates.

You may not use the platform to:

• Verify individuals without their consent or for purposes other than employment background checks
• Conduct surveillance, stalking, harassment, or any unauthorised investigation
• Process data of minors (persons under 18 years of age)
• Resell, redistribute, or white-label the platform or its results without written permission
• Attempt to reverse-engineer, scrape, or extract underlying data, APIs, or algorithms
• Submit false, fabricated, or manipulated candidate information
• Interfere with platform security, infrastructure, or other users' accounts

We reserve the right to suspend or terminate accounts found in violation of these rules, without refund.

• Pricing is displayed on the platform and may change with 14 days' notice to existing clients.
• Orders are prepaid at the time of placement. Each order is priced based on the checks selected.
• Bulk discounts are applied automatically at checkout based on the applicable tier at the time of purchase.
• All prices are exclusive of GST. GST at the applicable rate will be charged additionally.
• Payments are processed by Razorpay. By making a payment you agree to Razorpay's terms of service.
• Refunds: All payments are final. Orders are non-refundable once placed. In the event of a technical failure on our part that prevents a check from completing, we will assess the situation on a case-by-case basis.
• GST-compliant invoices are generated automatically and available in your dashboard.

As a Client, you act as a Data Fiduciary in respect of your candidates under the DPDP Act 2023. You agree to:

• Comply with the DPDP Act 2023 and all applicable privacy and data protection laws in your use of verification results.
• Not store, share, or use candidate personal data (including verification reports) beyond the purpose for which consent was obtained.
• Maintain your own records of candidate consent if required for your own compliance obligations.
• Promptly action any candidate request for erasure or data access that comes directly to you, and notify us if it relates to data held on the platform.

Our full data handling practices are set out in our Privacy Policy.

• Verification results are sourced from government databases, third-party APIs, and public records. We do not guarantee their completeness, accuracy, or timeliness.
• Results marked "No Result" or "Unable to Verify" indicate the check could not be completed, not that the information is false.
• You must not rely solely on a PehchanKaun report to make employment decisions. You remain responsible for your own due diligence.
• Results reflect the state of data in source databases at the time of the check. We are not liable for database errors, outages, or delays at third-party providers.

The PehchanKaun platform, including all software, designs, algorithms, reports, and branding, is the exclusive property of Transformatrix Pvt Ltd. You receive a limited, non-exclusive, non-transferable licence to use the platform for lawful background verification purposes only.

Verification reports generated for a specific candidate are licensed to the Client that ordered them for internal use only. Reports may not be reproduced, redistributed, or shared with third parties without written consent from Transformatrix Pvt Ltd.

To the maximum extent permitted by applicable law:

• Our total liability for any claim arising from your use of the platform is limited to the amount you paid for the specific order that gives rise to the claim.
• We are not liable for indirect, consequential, incidental, or special damages, including loss of business, loss of profits, or employment decisions made based on verification results.
• We are not liable for service interruptions caused by third-party API providers, government database outages, or force majeure events.

You agree to indemnify, defend, and hold harmless Transformatrix Pvt Ltd, its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from:

• Your use of the platform in violation of these Terms
• Your failure to obtain valid candidate consent before initiating checks
• Your use of verification results in violation of applicable law
• Any third-party claims arising from your employment decisions

Either party may terminate the account at any time. Upon termination:

• Prepaid orders are non-refundable once placed (see Section 6).
• You will lose access to the dashboard, reports, and candidate data stored on the platform.
• We will continue to comply with our DPDP obligations for candidate data — the 90-day anonymisation cycle will complete normally.
• We may terminate accounts immediately for material violation of these Terms, applicable law, or the DPDP Act 2023, without refund.

These Terms are governed by the laws of the Republic of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

We may revise these Terms from time to time. Material changes will be notified via email to the registered account holder at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.
